Workplace Accidents

Workplace Accidents and Workers’ Compensation

Fight for Fair Compensation with a Chicago Workers Compensation Lawyer

Every day people are injured in the course of performing their work-related duties. Monetary compensation is available to those who have been injured under these circumstances. If either you or someone you know has been injured in the workplace, you are entitled to financial benefits while you are unable to work. In addition, Goldman & Associates may be able to help you receive a lump sum settlement on top of the mandatory benefits.

Workers’ compensation is usually paid out through your employer’s insurance company whose best interests are not necessarily in your best interest. They have attorneys, investigators, and adjusters who are actively trying to minimize the payout you receive. If you want to balance the scales, you should hire an experienced attorney to advocate for your interests.

At Goldman Injury Law, we have represented workers’ compensations claims from Chicago area clients in a variety of industries. They’ve included delivery and truck drivers, construction workers, laborers, union workers, office personnel, healthcare workers, and more.

Important Facts from Chicago’s Leading Workers Compensation Lawyers

The material on this page breaks down the legal rights for you in terms of benefits afforded an injured worker under the Workers Compensation Act and Civil Law of Illinois. The Illinois Workers’ Compensation Act outlines the rights of injured workers.

Protection from Retaliation

The Illinois Workers’ Compensation Act protects you against any kind of discrimination or retaliation on the basis of your workers’ compensation claim. Any action of this type is illegal, and if you have been threatened with or actually fired, demoted, not given adequate hours, or given any unfavorable treatment as a result of a workers’ compensation claim, you may be able to receive significant compensation.

In addition, injured workers are entitled to:

Medical expenses
100% of all medical expenses are covered. No deductible or co-insurance payment is required.
Choice of doctors
You can choose two doctors for your treatment. You are also entitled to treatment from doctors to whom you are referred.
Partial Permanent Disability (PPD)
Also known as a lump sum settlement, this benefit is meant to compensate you for your injuries if you suffer from partial loss of the use of a body part. The amount of these benefits is determined by what body part is permanently impaired and how that will affect your life.
Permanent Total Disability (PTD)
If your injury leaves you unable to do any kind of work or you lose two of the same body parts (i.e. both hands), you are entitled to benefits for life. These benefits are also based on two-thirds of your average gross weekly wage.
Temporary Total Disability (TTD)
If you need to be off work to heal from your injuries, you are entitled to a weekly lost wage benefit. This sum is calculated based on two-thirds of your average gross weekly wage.
Wage Loss Differential
If your injury prohibits you for doing your job and you must take a lower paying job, you may be entitled to a benefit equal to two-thirds of the difference between the average gross weekly wages of each job.
Vocational Retraining
If you cannot return to your job because of your injury, you may be entitled to compensation for retraining in another occupation.
Survivor benefits
If a worker is killed on the job, his or her dependent heirs are eligible for workers’ compensation benefits.
